However, if you are a member of a rewards or loyalty program that we service, we may share your personally identifiable information with manufacturers, retailers or veterinarian hospitals that sponsor or participate in such reward or loyalty program. We may also share your personally identifiable information with our website hosting partners, and other parties who assist us in operating our website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. We may also release your information when we believe release is appropriate to comply with the law, enforce our site policies, or protect ours or others’ rights, property, or safety.

However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses.

California Online Privacy Protection Act

CalOPPA is the first state law in the nation to require commercial websites and online services to post a privacy policy. The law’s reach stretches well beyond California to require a person or company in the United States (and conceivably the world) that operates websites collecting personally identifiable information from California consumers to post a conspicuous privacy policy on its website stating exactly the information being collected and those individuals with whom it is being shared, and to comply with this policy.

California Consumer Privacy Act

The California Consumer Privacy Act (“CCPA”) only applies to California residents. Under the CCPA, Astro Loyalty, LLC is a “Service Provider” to any manufacturer, retailer or veterinarian hospital who (i) sponsors a loyalty program and contract with us for services related to such program (each, a “Sponsor), or (ii) otherwise uses our services in connection with a third party sponsored program (a “Participant”). As a Service Provider, Astro Loyalty certifies that it understands the restrictions set forth in the CCPA and will not: (i) sell any personal information; (ii) retain, use, or disclose any personal information for any purpose other than for the specific purpose of performing the services specified herein or any other agreement with a Sponsor or Participant, including retaining, using, or disclosing the personal information for a commercial purpose other than providing the services specified in the agreement with the Sponsor or Participant, or (iii) retain, use, or disclose any personal information outside of the direct business relationship between Astro Loyalty and the Sponsor or Participant.

About the Personal Information we receive or collect.

A. Personal Information Received or Collected From:

(i) Sponsors or Participants that you purchase pet products from; and

(ii) Your use of Astro Loyalty’s Website, Mobile App., or other Astro Loyalty services

B. Type of Personal Information That May Be Received or Collected:

(i) Name;

(ii) Address;

(iii) Telephone Number; and

(iv) Purchases of products from Sponsors or Participants, including date and amount.

C. Purposes for Receipt or Collection of Personal Information:

(i) Operate the Astro Loyalty programs that you participate in;

(ii) Improve Astro Loyalty’s Website, Mobile App., and services; and

(iii) Notify you about relevant promotions or special offers.

D. Types of Third Parties With Whom Your Personal Information May be Shared:

(i) Sponsors and Participants, and

(ii) Third party service providers of Sponsors or Participants as required by contractual terms.

California Residents’ Rights Under CCPA. Under California law, California residents can exercise three privacy rights (Disclosure and AccessDeletion; and “Do Not Sell My Personal Information”), which are described in more detail below. These rights are not absolute and are subject to certain exceptions. For instance, a Sponsor, Participant or Astro Loyalty cannot disclose or permit access to specific pieces of personal information if the disclosure or access would present a certain level of risk to the security of the personal information, or the security of the businesses’ systems of networks. Please note that California residents have a right not to be discriminated against for the exercise of their Rights.

Verification and Record-keeping. If you are a California resident, at the consent and direction of the Sponsor or Participant, Astro Loyalty will process your request to exercise your Rights in accordance with California Laws. When such a request is made, steps may be taken to verify your identity to protect your privacy and security. Further, if you designate an authorized agent to make a request on your behalf, you may have to submit information confirming such designation. Subject to California Laws, your request will not be acted on until your identity has been sufficiently verified. A record concerning the requests may be maintained pursuant to certain legal obligations. Further, a reasonable fee may be charged or a request may be refused if such request is excessive, repetitive or manifestly unfounded.

Disclosure and Access Requests. California consumers have the right to request, for the 12-month period preceding the date of the request, (i) the categories of personal information collected about them, (ii) the categories of sources from which personal information is collected, (iii) the business or commercial purpose for the information collection, (iv) the categories of third parties with whom the sponsor have shared personal information, and (v) the specific pieces of personal information the Sponsor or Sponsor’s service provider hold about an individual. Please note that Disclosure and Access requests from a consumer are only required to be fulfilled twice per every 12-month period.

California consumers can make a Disclosure and Access request, subject to the exceptions in the CCPA, by contacting the retail Participant of the program directly or by contacting us as provided below.

Deletion Requests. California consumers have the right to have their personal information deleted, subject to certain exceptions (for example, to comply with legal obligations, complete transactions or for our certain internal uses). In the course of fulfilling a valid deletion request, Astro Loyalty will also endeavor to direct any service providers that Astro Loyalty engages to delete your personal information from their records.

California residents can make a personal information deletion request, subject to the exceptions in the CCPA, by contacting the retail Participant in program directly or by contacting the Sponsor of the program directly or contacting us as provided below or the Sponsor of the program contacting us as provided below.

“Do Not Sell My Personal Information” Requests. As provided above, Astro Loyalty is a Service Provider as defined in the CCPA and certifies that it will not sell any Personal Information. The information about this right is included so that you may better understand your rights under the CCPA if you are California resident.

California consumers have the right to opt-out of having their personal information sold. Under the CCPA, the definition of “sale” includes a typical sale (i.e., a transfer of data from a seller to a buyer in exchange for money), but it also includes sharing of personal information with a third party in exchange for anything of value (money or otherwise).

Subject to applicable law, opting out will not prevent your personal information from being shared with third parties for certain purposes (for example, to process your transactions). Further, this opt out mechanism will not prevent the transfer of personal information in connection with certain transactions such as a merger, acquisition, bankruptcy or sale of company assets.

California consumers can make a “Do Not Sell My Personal Information” request, subject to the exceptions in the CCPA, by contacting the retail Participant of the program directly.

COPPA (Children Online Privacy Protection Act)

When it comes to the collection of personal information from children under 13, the Children’s Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission, the nation’s consumer protection agency, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children’s privacy and safety online.

We do not specifically market to children under 13.

Fair Information Practices

The Fair Information Practices Principles form the backbone of privacy law in the United States and the concepts they include have played a significant role in the development of data protection laws around the globe. Understanding the Fair Information Practice Principles and how they should be implemented is critical to comply with the various privacy laws that protect personal information.

In order to be in line with Fair Information Practices we will take the following responsive action, should a data breach occur:

We also agree to the individual redress principle, which requires that individuals have a right to pursue legally enforceable rights against data collectors and processors who fail to adhere to the law. This principle requires not only that individuals have enforceable rights against data users, but also that individuals have recourse to courts or a government agency to investigate and/or prosecute non-compliance by data processors.

CAN SPAM Act

The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations.
